DUI Records And The Need To Expunge It

To be arrested for drunk driving is a problem which plagues the offender even after he/she has suffered the consequences. The DUI violation will reflect on his/her records and some DUI records will be formed. This can lead to the revoking of the offenders driving license or the offenders insurance premium can shoot up. The offender may also lose a child custody case (if he/she is fighting one) and the biggest consequence is that the offender may lose his/her job.

If the offender has recently been convicted or arrested for a DUI offense, then he/she has many things to consider before telling about the DUI on their job application. First, of all the offender should see if he/she is eligible to clear the DUI record or not. This should be done before the offender starts applying for different jobs. This is very important because 90 percent of the times a new employer runs a background check on the prospective employees, which includes checking their DUI records. In case if the employer finds a DUI offense then there is a chance that the job application may get rejected.

The background and DUI records are checked by 3rd party HR companies. These companies employ professional ways to conduct pre-employment background checks. If there is even a little discrepancy on the DUI records then these companies can easily track it. Therefore, a person applying for a job should check if his/her DUI records can be cleared.

The offender should take steps to expunge or clear his /her DUI records before applying for a job. There is a big possibility that the prospective employee will not discover it. Yes, it is possible that the DUI records can be taken care of by just investing a little time. This is however not possible in some states because all of them do not allow to clear or expunge the DUI records. These states, however, have a feature which stops the DUI records from appearing on the background checks.

If the person is a law abiding citizen, then there is a big chance that his/her old arrests or convictions can be erased from all the records. However there are certain circumstances under which the DUI records can be cleared or expunged. For example, if the offender was convicted or he/she pleaded guilty for a misdemeanor more than 5 years ago, and he/she has not been convicted again after that.

If a person convicted for DUI comes under this consideration then he/she should hire a qualified expungement lawyer to file a petition for the expungement of the DUI records. This move will save his/her personal life from getting affected.
